Resident Raises Concerns Over Ordinance Compliance and Months-Long Records Request Delay (2025–2026)

A Lake St. Croix Beach resident has raised concerns about a construction project that may not have followed required city procedures, along with a public records request that has gone unanswered for more than four months.


The concerns were shared with Washington County officials after repeated attempts to obtain information locally.



Overview

A resident of Lake St. Croix Beach has raised multiple concerns related to local government processes, including ordinance compliance, public notice, and delays in responding to public records requests.


The concerns were outlined in a written communication to Washington County Commissioner Bethany Cox, with a copy provided to the County Administrator’s Office.


Construction and Ordinance Concerns

The concerns center on a construction project that, according to the resident, did not follow standard planning and variance procedures required under city ordinances.


The project was initially described as a garage but appears to have been constructed in a different form, raising questions about classification and compliance with size limitations.


According to the resident, the project did not go before the Planning Commission, and no variance hearing was held prior to construction.


Additional concern was raised that a variance may now be considered after construction has already taken place.


Public Notice and Process

Questions were also raised regarding whether proper notice was provided to surrounding property owners.

It remains unclear whether a formal variance application was submitted or publicly posted prior to or during construction.


Public Records Request Delay

On November 11, 2025, the resident submitted a written public records request using the city’s official form, which was stamped by the city clerk.


More than four months later, the requested records have not been provided, and no substantive response has been received.


The resident indicated that similar delays have been experienced by others.


Broader Concerns

The communication reflects broader concerns among some residents that questions raised at meetings are not being addressed directly, ordinances may not be applied consistently, and requests for information are not being handled in a timely manner.


Some residents have expressed reluctance to raise concerns publicly due to uncertainty about how those concerns will be received.


Escalation to County Officials

After several months without response, the resident contacted Washington County officials seeking guidance on how to proceed, including questions related to compliance with the Minnesota Government Data Practices Act.
